Nomadays operates a platform enabling French-speaking travellers to design and book trips in collaboration with local partner agencies specialised in their destination.

In this context:

Nomadays is responsible in particular for the marketing of the trips, the contractual relationship with travellers, the collection of payments, the administrative management of files as well as the coordination of the customer relationship;
the local partner agency is responsible for the design of the trip, its operational organisation, its execution at the destination as well as the local assistance of travellers;
the respective roles of Nomadays and the local agency applicable to each trip are specified in the contractual documents provided to the traveller.

These General Terms of Use (GTU) govern access to and use of the Site by any user.

ARTICLE 2 — DEFINITIONS

Site: platform accessible at the address www.voyagekirghizistan.com.

User: any person browsing the Site.

Customer: any person making a request or booking a trip.

Nomadays: travel agency registered in France operating the Site.

Local partner agency: local partner responsible for the design, organisation and execution of the trip at the destination.

Services: all the services offered via the Site.

ARTICLE 3 — ACCESS TO THE SITE

The Site is accessible free of charge to any user with internet access.

Nomadays endeavours to ensure continuous access to the Site without guaranteeing permanent availability.

Interruptions may occur in particular for maintenance, updates or technical reasons.

ARTICLE 4 — ROLE OF THE PARTIES

4.1 Role of Nomadays

Nomadays acts in particular as:

a travel agency registered in France;
the traveller's contractual point of contact;
a booking and file management platform;
an interface between the traveller and the local partner agency.

Nomadays is responsible in particular for:

the presentation of the trips;
the contractual relationship with the traveller;
the collection of payments;
the administrative management of files;
the transmission of the information necessary for the organisation of the trip;
supporting the traveller in the event of difficulty or complaint.

4.2 Role of the local partner agency

The local partner agency is responsible in particular for:

the design of the trip;
the selection of local service providers;
the bookings necessary for the execution of the trip;
the operational organisation of the stay;
the local assistance of travellers;
the management of operational incidents at the destination.

4.3 Assistance and coordination

In the event of difficulty during the trip, the local partner agency intervenes as a priority in order to find a suitable solution.

The traveller may contact either the local partner agency or Nomadays.

Nomadays supports the traveller and acts as a coordination interface with the local agency in order to facilitate the resolution of the difficulties encountered.

The parties cooperate in order to ensure the proper execution of the trip and the satisfaction of the traveller.

ARTICLE 5 — OBLIGATIONS OF THE USER

The User undertakes to:

use the Site in accordance with the law;
not impair the operation of the Site;
provide accurate information when making requests or bookings.

The login credentials for the customer area are strictly personal and confidential.

ARTICLE 6 — LIABILITY RELATING TO THE SITE

Nomadays may not be held liable for:

temporary interruptions of the Site;
problems related to telecommunication networks;
incorrect use of the Site by the User;
events beyond its control affecting access to the Site.

The conditions of liability relating to the execution of the trip are governed by the terms of sale and the contractual documents provided to the traveller.

ARTICLE 7 — INTELLECTUAL PROPERTY

All content on the Site, in particular the texts, images, videos, illustrations, logos, databases and software, is protected by the provisions relating to intellectual property.

Any reproduction, representation, distribution or exploitation, in whole or in part, without the prior written authorisation of Nomadays is prohibited.

ARTICLE 8 — PERSONAL DATA

The processing of personal data is carried out in accordance with the applicable regulations and in particular the General Data Protection Regulation (RGPD/GDPR).
